Our trading premises are not normally open to the public. Visits and collections must be agreed with us in advance.
In these terms, “we”, “us” and “our” mean Model Railway Magic Ltd trading as The Model Tree Shop. “You” and “your” mean the person placing an order.
These terms apply to purchases made by consumers through themodeltreeshop.co.uk. Separate terms may apply to trade customers and other business purchases.
Please read these terms before placing an order.
These terms, together with the relevant product description and the delivery information shown on our website, form the agreement between you and us.
Nothing in these terms limits or removes your statutory consumer rights.
We may change these terms occasionally. The terms applying to an order will be those published when the order is placed.
We make reasonable efforts to describe and photograph our products accurately.
Many model trees and landscaping products are handmade, hand-finished or manufactured from flexible materials. Their shape, colour, foliage distribution and dimensions may therefore vary slightly between individual examples.
Unless a product page states otherwise:
These natural or minor manufacturing variations are not normally faults. This does not affect your rights where a product differs materially from its description.
Please check the stated dimensions before ordering. Model railway scale alone is not always a reliable guide to the most appropriate tree size.
Some products contain small parts, adhesives, aerosols or other materials requiring careful handling. Please read and follow the instructions and warnings supplied with the product. Products should not be treated as toys unless expressly described as such.
You can place an order through our website by adding products to your basket and completing the checkout process.
Please check your order, delivery address and contact details carefully before submitting it.
Your order is an offer to purchase the products shown in your basket. An automated order acknowledgement confirms that we have received your order, but it does not mean that we have accepted it.
We accept your order when we send you confirmation that it has been dispatched. At that point, a contract is formed between you and us.
We may be unable to accept an order because:
If we cannot accept an order after payment has been taken, we will tell you and refund the affected amount.
We will not substitute a materially different product without your agreement.
Prices shown on product pages include UK VAT unless stated otherwise.
Delivery charges are additional and are shown during checkout. Current delivery information is also available on our Shipping Costs page.
We accept the payment methods displayed during checkout. These may include debit or credit card, PayPal and bank transfer.
Card payments are processed by third-party payment providers. We do not receive or store your complete card details.
Where payment is made by bank transfer, we will not normally dispatch the order until cleared payment has been received.
We take reasonable care to ensure prices are correct. If we discover an obvious pricing error before accepting your order, we will contact you. You may then confirm the order at the correct price or cancel it for a full refund.
Promotional codes:
Products are subject to availability.
Although our website displays stock information, occasional stock discrepancies can occur. If an item is unavailable, we may:
We may limit the quantity of a product that one customer can purchase where this is reasonably necessary.
Delivery options and charges are shown during checkout.
We normally aim to dispatch in-stock orders within one working day, excluding weekends and bank holidays. This is an aim rather than a guaranteed dispatch time.
Any delivery date or timescale is an estimate unless we have expressly agreed a guaranteed service with you.
Unless a different timescale has been agreed, we will deliver your order within 30 days of accepting it.
We may:
You are responsible for providing a complete and accurate delivery address.
If an order is returned to us because the address was incorrect, the parcel was refused or it was not collected from the carrier, we may ask you to pay the reasonable cost of redelivery.
Please contact us if an order has not arrived within the expected delivery period. A carrier’s tracking status does not remove our responsibility to ensure that your order is delivered.
Overseas delivery charges are normally calculated using the destination, weight, dimensions and contents of the order.
Where the checkout cannot calculate an appropriate delivery charge, we may contact you before accepting the order. You can cancel the order for a full refund if you do not wish to pay the revised delivery charge.
Products delivered outside the UK may be subject to:
Unless expressly stated otherwise, these charges are not included in the amount paid to us and are the responsibility of the recipient.
Customs procedures may delay delivery. We are not responsible for delays caused by customs authorities that are outside our reasonable control.
Some products, including certain aerosols and liquids, cannot be sent to all destinations. Any relevant restrictions will normally be stated on the product page or during checkout.
Please contact us promptly if you wish to change or cancel an order.
Where the order has not been dispatched, we will normally cancel it and issue a full refund.
We cannot guarantee that an order can be changed or stopped after it has entered the packing or dispatch process. If it has already been dispatched, you may use the cancellation rights described below.
For most products purchased online, you have the right to change your mind and cancel the contract without giving a reason.
The cancellation period ends 14 days after:
To cancel, you must tell us clearly that you have decided to cancel. You can do this by emailing help@themodeltreeshop.co.uk
You do not have to use the cancellation form.
After telling us that you wish to cancel, you must return the goods within 14 days.
The right to cancel may not apply to products that are:
Where an exception applies, we will make this clear before you purchase the product.
A product is not treated as personalised merely because it is handmade or because you selected a standard size, colour or variation offered on the product page.
Before returning an order, please contact us and provide:
Return products to:
The Model Tree Shop
Unit 15
The Bull Centre
Stockton Lane
York
YO32 9LE
You are responsible for the direct cost of returning an unwanted product.
Please:
You are responsible for the product until it reaches us.
Please contact us before returning aerosols, liquids or other products that may be restricted by postal or courier services.
You may inspect a product as you reasonably would in a shop. We may reduce the refund to reflect any loss in value caused by handling beyond what was reasonably necessary to establish the product’s nature, characteristics and function.
Opening packaging does not automatically remove your right to cancel.
We do not charge a restocking or administration fee for exercising your statutory right to cancel.
Where you properly cancel an order, we will refund:
If you selected an enhanced or more expensive delivery service, we do not have to refund the difference between that service and our standard delivery charge.
We may withhold the refund until:
whichever happens first.
We will issue the refund within 14 days of that date.
Refunds will normally be made using the original payment method unless we agree otherwise. You will not be charged a refund fee.
We are legally responsible for supplying products that:
Please contact us if a product is faulty, materially different from its description, damaged in transit or not the product ordered.
Providing your order number and photographs of the product and packaging will often help us resolve the matter more quickly. We may ask you to retain the packaging while we investigate a transit claim.
Please do not dispose of a damaged or faulty product unless we ask you to do so.
Where a product is faulty, damaged or incorrect, we will provide an appropriate remedy. Depending on the circumstances, this may include:
Consumers normally have a short-term right to reject faulty goods within 30 days. Further rights to repair, replacement, a price reduction or refund may apply after that period.
Any request that you contact us promptly about transit damage is intended to help us investigate with the carrier. It does not remove or reduce your statutory rights if you contact us later.
Normal variation between handmade or hand-finished products is not necessarily a fault, provided the product remains consistent with its description.
The goods become your responsibility when they are delivered to:
Ownership of the goods passes to you once we have received payment in full and the goods have been delivered.
Any additional conditions displayed on a digital gift voucher, its product page or the email in which it is supplied form part of these terms.
Digital gift vouchers:
Please check the recipient’s email address carefully. Contact us promptly if a voucher has been sent to an incorrect address.
Your statutory rights are not affected.
We are responsible for losses you suffer that are a foreseeable result of our breach of these terms or our failure to use reasonable care and skill.
We are not responsible for:
Nothing in these terms excludes or limits our liability for:
Information and guides published on our website are provided for general modelling purposes. You remain responsible for checking that a product, adhesive, tool or technique is appropriate for your intended use.
We are not responsible for delay or failure caused by circumstances outside our reasonable control.
These may include severe weather, transport disruption, industrial action, customs delays, interruption of postal or courier services, fire, flood, utility failure or disruption to telecommunications systems.
We will take reasonable steps to minimise the effect of the delay.
If there is a substantial delay, you may contact us to cancel the affected order and receive a refund for products you have paid for but not received.

You may view and print website content for personal, non-commercial use.
You may not reproduce, republish, distribute or commercially exploit our website content without prior written permission, except where permitted by law.
Product information supplied by manufacturers remains subject to their own intellectual-property rights.

We use personal information to process orders, take payments, arrange delivery, provide customer service and operate our business.
Further information about how we collect, use and protect personal information is provided in our Privacy Policy and Cookie Policy.
Please contact us if you are unhappy with a product or our service:

Please include your order number and enough information for us to investigate.
We will try to resolve complaints fairly and within a reasonable period.
If we do not immediately enforce a right under these terms, this does not mean that we have waived it.
If a court finds that part of these terms is unlawful or unenforceable, the remaining terms will continue to apply.
No person other than you and us has the right to enforce the contract between us.
We may transfer our rights and obligations to another organisation, but this will not affect your rights. You may transfer your rights only with our written agreement or where the law permits it.
These terms are governed by the law of England and Wales.
If you live in England or Wales, the courts of England and Wales will have jurisdiction.
If you live in Scotland or Northern Ireland, you may also bring proceedings in the courts of the country in which you live.
Nothing in this section removes any mandatory consumer protection applying in your country of residence.
